UPDATE: State selects outside counsel; gay couples allowed to file joint state tax returns

UPDATE: Yesterday, Utah Attorney General Sean Reyes named the three attorneys who have been selected to take charge of Utah’s same-sex marriage appeal. They are: Gene C. Shaerr, an appellate and Supreme Court expert who is originally from Utah but has been practicing law in Washington, D.C.; John Bursch, a former Solicitor General from the state of Michigan; and Monte Neil Stewart, an attorney from Idaho. With the aid of two assistant attorneys general, the three will have until Jan. 27 to complete and submit the state’s first argument to the 10th Circuit Court of Appeals in Denver.

In representing the State of Utah, Schaerr has agreed to cap his fees at $200,000; Bursch and Stewart will each cap their fees at $50,000. Conservative public policy think tank the Sutherland Institute, based in Salt Lake City, has said it will shoulder the entirety of the expense. The Sutherland Institute was heavily involved in the attorney selection process.

In a rather surprising move, the Utah State Tax Commission decided yesterday that it will allow same-sex married couples to jointly file their state income tax returns this year.
