Varlo DavenportIf you’ve taken on the insanity of following my column for any period of time, you’ll likely notice that I do not often get into the comments section. I equate this mostly to the fact that once something I have written is fact-checked, edited, and published, I don’t really even own it anymore. It’s done. On to the next, right?

This however does not preclude me from marveling at people’s responses and last week, one particular would-be anonymous (they’re not) commenter who quite aptly named himself “Pig Tut” embodied so perfectly what many consider to be a quantifiably rapacious problem here locally that I am going to respond to here in this week’s column.

In response to last week’s column about the unethical and quite possibly illegal behavior of Judge Ron Read, Assistant Attorney General Michael Carter, and by association the City of St. George and Dixie State University, Pig Tut writes, first quoting the column and then bloviating astutely:

“’Are you thinking what I have been thinking for a long time now? What in the actual Hell is a public university engaging in when it utilizes an off-campus, unregulated, anonymous whistleblower site? The site is said to be spearheaded by DSU Board of Trustees member, prominent local businessman, and church leader David Clark. A topic for another day?’

This paragraph is the typical tripe that this entire article is made of. Off-Campus and unregulated, seriously! Of course such sites are unregulated and off-campus, other wise they would not be anonymous!!!!! What does David Clarks’ religion have to do with this. The internal audit office is the office that select the site and that is based on a RFP designed to select a company who both provides a good website, but who also protects the anonymity of the people who file complaints. David Clark has nothing to do with it. In fact, David Clark is the one who has encouraged the Internal Auditor to select the best site possible and to do all they can to encourage people to file complaints of wrong doing.'”

So before taking this on a couple of lines at a time, it’s worth noting that the courage and veracity of anonymity is likened to the man with the spine of an eclair. The irony is not lost on me, however, that the one who staunchly defends an anonymous whistleblower site prefers to remain anonymous. I’m thinking of a word here … starts with a “P.” Ends with a “Y.” Rhymes with “coward” if you say it right.

But in the end, that is what the people who maintain the whistleblower site and those who use it for that matter are. Cowards.

Oh yes, and they are hideously ignorant of the law.

So, Pig Tut, here goes.

You repugnant, ignorant troglodyte. You neither understand nor concern yourself apparently with the premise of innocence until proof of guilt, due process of law, the right to face one’s accuser, and a host of other moral and ethical premises. Your defense of an unregulated off-campus site is neither consistent with the laws of this land nor the governing principles of public universities.

Foregoing due process of law in the matter of an accusation of any sort from one person to another being perpetrated under color of law only serves to demonstrate how absolutely necessary it is for perhaps a major house cleaning of upper-level administration of that school. At this point, given the numerous civil lawsuits already lost by the school, coupled with the ones accruing, and adding to that things like the head of the athletic center dismissing a female student from the gym for “baring her shoulders” of all things, it is painfully obvious that DSU stubbornly refuses to learn from it’s mistakes. In fact, not only is it not learning, it is stubbornly continuing to perpetuate them which means that perhaps some “education” is in order. Perhaps it is time for a comprehensive complaint to the Department of Justice and an audit of the school top to bottom, up to and including all of its finances.

The leaders of this community will often pontificate about how great this little town is and how they just want to keep things the same.

Mind if I ask, “Great for whom? Those in the club?”

Because from the vantage point of a growing number of people victimized by things like the shit show these people are calling a “fair trial” of Varlo Davenport, this place is quite treacherous if one finds themselves on the receiving end of the actions of people like Pig Tut who do not understand the core tenants of our judicial system.

As for the whistleblower site and the prosecution in Davenport’s case maintaining that anonymity is assumed by a fictionally legal entity, please — for everyone’s enlightenment — cite the law that affirms this assertion.

Is it apropos to cite Hitchens here?

“That which can be asserted without evidence can be dismissed without evidence.”

The City of St. George needs to drop this case. It has, even under court order, refused to provide the evidence being used to prosecute this man. This likely is because it either does not exist, or was illegally obtained or even fabricated. And if any of that is proven true, some people at the city and school need to face prosecution. And you can bet your lily ass that if they did, they would require the rule of law to be followed and would not stand for any “anonymous” accusations.

Let’s call these people what they truly are people: criminals. But it is worse than that. They are criminals who cloak themselves in the goodness and integrity of elected and appointed positions of administration, government, and church. It is the ugliest and most abhorrent of  wrongdoings to abuse the public trust.

Keep your eyes on this case, folks. The defense filed a motion to remove Judge Ron Read last week, and the outcome of that will be telling. If he will not step down on his own accord, it is more than reasonable at this point to maintain that he must be legally removed.   1. I have said this many times over the years in the comment section of the Independent. VINCIT OMNIA VERITAS – TRUTH CONQUERS ALL. There is no doubt the best course of action is for the city is to suck it up and drop the case. But the sin of pride, and as they refer to in China – LOSING FACE – stands in the way. Many lives have been affected by an incident on all sides and irreparable damage to human beings with real beating HUMAN HEARTS has occurred. All sides have victims. As I said in my own mysterious way in the comment section of the previous opinion regarding this, PIGTUT’s remarks were just a tangent pure and simple, and at best sociopathic, vain, and likely written by a legal or academic oriented individual with a stake in the matter. I too have been a victim of this city. And with all due respect to the student, would gladly take the hardest slap on my face possible, then go thru my experience again. Yes I am anonymous, but I have my reasons. I did officially document the violation of my constitutional rights in the Spectrum using my name and address. And yes, I too could file a lawsuit, but that is not who I am. I have to think about the welfare and situation of other human beings involved. I have forgiven. WE ARE BETTER THAN THIS. I will say this, Dallas will not let up his full court press until justice prevails. And if things go further, it will continue to spiral downwards hurting everybody. Can’t anybody see this is a LOSE LOSE situation. Time for leadership in this town to buck up and figure out the best solution. This is a minor battery case that has been thrown out of proportion by a certain cabal. As far as Pigtut is concerned, he brought up the number 78. It seems it is showing up everywhere… (see document filed) 1+2+3+4+5+6+7+8+9+10+11+12 = 78… Of course the origin of 78 is contained in the number 12… as in 12 zodiac signs, 12 apostles, 12 tribes, 12 knights of the roundtable… etc… truly a great number indeed.
